Terms and Cancellation Policy for Santana Sail

1. Booking Terms and Conditions

  • Booking Confirmation: To secure your booking, a deposit of 50% is required at the time of reservation. The remaining balance is due 30 days before the charter date. All bookings are considered confirmed upon receipt of the deposit and payment of the balance. A 15% VAT tax will be added to all tours.
  • Payment Methods: We accept payments via [credit card and bank transfer]. If payment is not received by the specified date, the booking may be subject to cancellation without notice.
  • Charter Duration: The agreed-upon charter duration is fixed and non-adjustable unless both parties agree to a change. Additional hours beyond the booked duration will incur extra charges of $50 per person per hour and must be paid on the day of the charter.
  • Passenger Limitations: The boat’s capacity is limited to [25] passengers. The safety of our guests is our primary concern. Overcrowding is strictly prohibited, and any guests exceeding the capacity will not be allowed to board.
  • Conduct and Behavior: All guests are expected to behave in a respectful and safe manner while on board. Our crew reserves the right to disembark any passengers whose behavior is deemed unsafe, disruptive, or otherwise in violation of maritime laws.

2. Cancellation and Refund Policy

  • Guest Cancellations:
    • More than 60 days before the charter: Full refund of deposit minus a processing fee of $35.
    • Between 60 and 30 days before the charter: 50% refund of the total booking cost.
    • Less than 30 days before the charter: No refund. Full payment will be retained.
  • Cancellation by Us:
    • We reserve the right to cancel or reschedule your charter due to weather conditions, mechanical failure, or other safety concerns. In such cases, we will offer either:
      • A full refund, or
      • An option to reschedule your charter for another date, based on availability.

If the charter is cancelled by us, the deposit and any payments made will be refunded in full, or you may choose an alternative date subject to availability.

3. Weather Conditions

  • Weather-Related Cancellations: Sailing charters are subject to safe weather conditions. In the event of unsafe conditions (such as storms, high winds, or poor visibility), the charter may be postponed or canceled at our discretion. Safety is our number one priority.
    • If the charter is cancelled due to weather, you will be offered a full refund or the opportunity to reschedule for another date.
    • Guest’s Discretion on Weather: If you choose NOT to proceed with a charter in weather conditions that may be less than ideal but are deemed safe by the captain, we cannot offer a refund or rescheduling.

4. No-Show Policy

If you do not arrive for your scheduled charter at the agreed time and place, and no prior notice is given, no refunds will be issued.

5. Late Arrivals

Please arrive at least 30 minutes before the scheduled departure time. Delays may result in reduced charter time. The full price of the charter is still applicable.

6. Refunds

Refunds will be processed to the original payment method within 15 business days of cancellation confirmation. Please note that bank processing times may vary.

7. Liability

Client Responsibility: The client is responsible for the actions of their guests, and we reserve the right to refuse service or remove any passenger who exhibits unsafe, illegal, or inappropriate behavior.

8. Additional Terms

  • Alcohol and Drugs: Consumption of alcohol is allowed, but guests must comply with all local laws. The use of illegal drugs or substances on board is prohibited, and any guests found in violation of this rule may be removed from the vessel.
  • Damage to the Boat: Clients are responsible for any damage caused to the boat or equipment during the charter. If damage occurs, the client will be liable for the cost of repairs, either through the security deposit or additional charges.
  • Personal Items: We are not responsible for any lost, stolen, or damaged personal items during the charter. Please ensure that you take care of your belongings during the trip.
